Contracts & dispute resolution

Procurement and Tendering: Getting it right first time

If you are looking for expert legal guidance before and during the procurement and tendering phase then our lawyers are certainly right for you. We routinely advise clients on international procurement and tendering for “big ticket″ construction projects such as hydropower plants, wind farms, tunnels and roads. Getting these projects right at the start is critical to clockwork completion and avoiding disputes.

International Construction Contracts

We are recognized internationally as experts on the FIDIC suite of contracts – the most widely used international forms of construction contract (for more information on FIDIC click here). We also advise on other international forms of construction contracts such as the NEC and ICE, bespoke construction contract and national contracts such as the JCT. Our lawyer will direct you through all the other agreements for a major project such as the Concession Agreements, Operation and Maintenance Agreement, Offtake Agreement, Supply and Installation Agreements, Bonds and Guarantees, Joint Venture Agreement.

Adjudication | Disputes Resolution Boards

Anyone dealing with the FIDIC contract will be all too familiar with the Adjudication procedure for resolving disputes. The process is rather straight forward and we aim to keep costs at an absolute minimum yet with maximum results. Having extensively represented Employers and Contractors in adjudication matters we know exactly the position these participants normally take and can lead you in achieving the best outcome.

International Construction Arbitration

Given the nature of a construction project differences occur and clients need timely and sensible legal advice in ensuring their position is adequately protected. In matters that lead to disputes, we have the expert knowledge and experience to manage and resolve your matter efficiently and effectively with minimal delay and cost to your business and the project. We have acted, and are able to advise, Contractors and Employers on international arbitration matters under the following rules:

  • International Chamber of Commerce (ICC)
  • German Institution for Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit i.e., DIS)
  • Swiss Chambers (Swiss Chambers’ Court of Arbitration and Mediation)
  • Arbitration Institute of the Stockholm Chamber of Commerce (SCC)
  • Dubai International Arbitration Centre (DIAC); and
  • London Court of International Arbitration (LCIA)

Of course we can also advise you on arbitration matters under the UNCITRAL rules.

Construction Risk Management Advice: On-Time | On-Budget

Sir Michael Latham stated in his Latham Report: Constructing the Team, ″No construction project is risk free. Risk can be managed, minimized, shared, transferred or accepted, – it cannot be ignored″. Failing to properly identify and manage risk in a construction project from the outset can cause considerable delays, defects, increased costs and endless disputes between parties. In response, we provide On-Time | On-Budget advisory services focused on implementing strategies from procurement through to completion dealing with all possible problems and ensuring your construction project is On-Time and On-Budget.
