Aim of the WEBinar:

Familiarisation with the basic structures of the most important FIDIC contracts (Red, Yellow, Silver) against their common law background under comparative consideration of German construction law regulations (BGB and VOB/B).

Contents:

The almost unique structure of the seminar is based on a well-founded comparative legal analysis of the FIDIC contract structures and the underlying common law principles with German construction law principles. This didactic approach considerably simplifies the understanding of the FIDIC principles for those familiar with the construction law principles of the German Civil Code (BGB) and the German Construction Contract Procedures (VOB/B). The different principles of the most important FIDIC books are thus

 

- Red, Yellow and Silver - are analysed and explained. At the same time, the frequent conflicts of FIDIC contracts, which regularly cause problems when the parties agree on civil law as the applicable law or when such law influences the contract, are pointed out. Numerous practical examples and advice complete the picture.

Lawyer Dr Wolfgang Breyer
Dr Breyer is a pioneer in the field of IPA multi-party contracts and has drafted over 70% of all (IPA) multi-party contracts for major projects on the client side that have been concluded in Germany to date following accompanied award procedures (private and public) and has been/is involved in almost all of the other current projects on a multi-party contract basis for bidders in the award procedure or after the contract has been awarded.

Lawyer Dr Michael Burdinski
Dr Burdinski has supported bidders or bidding consortia in several award procedures for multi-party contracts, both on the planning and the construction side. He also has extensive experience in providing project support to contractors of a multi-party contract

Lawyer Prof Dr Mark von Wietersheim
Prof Dr von Wietersheim advises on the structuring and implementation of award procedures for IPA multi-party contracts for the public sector.

Against the background of the current IPA-MPV models in Germany, some of which are fundamentally different, and their novelty, the individual components of an IPA multi-party agreement and how they work together will be analysed from a legal and systemic perspective based on the lecturers' experience from over 100 award/negotiation workshops to date. A critical comparative analysis of the different approaches on the market, questions of practical implementation and market acceptance are also the subject of the seminar.

The participation fee is 200 euros for members and 300 euros for non-members.
