Im Rahmen der jährlich stattfindenden Vis Moot-Trainings bei BREYER durften wir dieses Jahr das Vis Moot Team Heidelberg, das Vis Moot Team Tübingen sowie das Vis Moot Team Freiburg begrüßen. Drei unserer Anwälte begleiteten die Teams durch ihre Pleadings und standen nach den Trainings für Feedback und Fragen zur Verfügung.
Dr. Wolfgang Breyer – selbst ehemals Schiedsrichter im Rahmen des Moot Courts in Hongkong und Wien – komplettierte die Trainings durch abschließende Tipps.
Beim anschließenden Get-together hatten die Teams die Gelegenheit, sich auch mit unseren anderen Anwälten und Anwältinnen bei Snacks und Getränken auszutauschen. Wir wünschen allen Teams viel Erfolg in Hongkong und Wien!

Letzten Freitag führten Jonas Schrodi, Felix Günter und Julius Kinzelmann interessierte Referendar*innen am Standort Stuttgart in das examensrelevante Bau- und Werkvertragsrecht ein.
Danach stellte Katharina Breyer unser Ref-Programm sowie unsere Förderprogramme für Berufseinsteiger*innen vor.
Last but not least hielt Dr. Wolfgang Breyer einen Vortrag zum Thema IPA und gab den Referendar*innen einen kleinen Einblick in das Berufsleben bei uns, bevor beim anschließenden Get-together noch Zeit für anregende Gespräche blieb.
Wir haben uns sehr über die vielen Teilnehmer*innen gefreut!

The Federal Court of Justice has ruled (BGH, judgement of 2 June 2022 - case no. VII ZR 174/19) that the minimum rates of the HOAI in the version from 2013 continue to apply as binding price law in old cases in ongoing court proceedings between private individuals.

The ECJ Advocate General consistently continues the line of ECJ case law on the minimum fee rates of the HOAI. There is no entitlement to fees in the amount of the minimum rates, not even for claims arising from contracts that arose before 1 January 2021 (Opinion of the Advocate General of 15 July 2021 in the case Thelen Technopark Berlin GmbH ./. MN, Ref. C-261/20).

On 16 September 2020, the German government adopted an amendment to the Fee Structure for Architects and Engineers (HOAI). In doing so, it is implementing the adaptation of the HOAI to the EU Services Directive made necessary by the ECJ judgement. The Federal Council approved the draft law on 6 November 2020. This means that nothing stands in the way of it coming into force on 1 January 2021.

According to the new decision of the BGH of 8 August 2019 - VII ZR 34/18 - the new unit price for excess quantities within the meaning of Section 2 (3) No. 2 VOB/B is no longer calculated on the basis of the original calculation (pre-calculated method), but on the basis of the actual costs required plus appropriate surcharges.
