Unlike public building law, private building law is an almost completely neglected area of law in law studies - despite its relevance as a compulsory subject in examinations.
Every student and trainee lawyer is familiar with terms such as development plan, building permit and demolition order. Construction contracts, property development contracts, architects' contracts, specifications, quality, functional suitability, on the other hand, are largely unknown as central concepts of private construction law - wrongly, in our opinion. This is because the practical relevance of this area of law is extremely high. What?
You can expect a three-part workshop as optimal exam preparation.
Part 1: Theory (starts at 10.30 am)
The aim of the workshop is firstly to teach the theoretical basics and individual questions of works contract law and private construction law that are relevant to the exam. Dr Wolfgang Breyer, one of the leading national and international construction lawyers and former tutor at the former ‘Juristische Forum Dr Jacoby Dr Breyer’ (Heidelberg, Freiburg), will explain the material clearly using a PowerPoint presentation.
Materials in the form of our index cards are provided for independent repetition of the material.
Part 2: The application
This will be followed by a joint case solution with a negotiation simulation (mock trial) to secure what has been learnt.
Our participants are given a case that they are initially allowed to work on in groups. During the preparation period, an experienced lawyer will be on hand to advise you as a coach.
You will then be assigned to the role of plaintiff/defendant. The court will be made up of lawyers from our firm. In the following trial simulation, the parties will exchange their arguments under the direction of the court and can apply the knowledge they have acquired in practice.
3rd part: Get-together (from approx. 4.00 pm)
The negotiation simulation will be followed by a get-together where you will have the opportunity to talk to the firm's lawyers. Catering will be provided.
